CHECKS & BALANCES

A fourth branch should add friction to concentrated power — including its own.

Institutional independence cannot mean institutional immunity. The strongest design pairs every consequential power with a separate source of review, resistance or correction.

DESIGN RULE

Power paired with counterpower.

The proposed branch should never rely on “trust us” as its principal safeguard. The safeguard belongs in the process, the record and the reviewing institution.

Proposed powerWhy it may be neededCounterpower
SubpoenaObtain relevant records or testimony when voluntary access is inadequate.Defined jurisdiction, particularity, challenge rights, proportionality, written predicate and judicial enforcement.
Evidence preservationPrevent destruction, alteration or disappearance of relevant evidence.Legal predicate, scope and time limits, notice where lawful, review and a durable audit trail.
Compelled testimonyResolve material factual questions that cannot otherwise be answered.Constitutional rights, privilege, counsel, lawful process, judicial review and documented necessity.
Classified accessPrevent secrecy from becoming automatic immunity for serious misconduct.Secure handling, need-to-know access, lawful classification protections, controlled publication and penalties for misuse.
Public findingsMake government conduct and government responses traceable.Evidence-status labels, subject response rights, redaction rules, source protection, correction procedures and published methodology.

“Congressional independence does not mean congressional immunity. National security does not mean immunity from oversight. Classification protects legitimate secrets, not misconduct.”

CIB may investigate powerful institutions precisely because its own exercise of power is constrained, documented and reviewable.
