CURRENT SYSTEM

Build on what works. Name the limits precisely.

The case for a Citizen Branch should begin by acknowledging the institutions that already investigate, audit, adjudicate, prosecute and disclose. The question is not whether they matter. It is whether their combined structure leaves a constitutional accountability gap.

Current institutionWhat it does wellStructural limit relevant to this proposal
CongressExercises broad investigative and oversight authority connected to legislative functions; can hold hearings, issue subpoenas, legislate and use appropriations. Its investigative power is tied to legislative purpose and operates through chambers and committees with political, jurisdictional and institutional incentives.
GAOThe Government Accountability Office is an independent, nonpartisan legislative-branch agency providing audits, evaluations, investigations and legal analysis for Congress. It is a congressional support institution, not a constitutionally citizen-governed branch with an independent public-accountability mandate.
Inspectors GeneralInspectors General conduct professional audits and investigations and have statutory independence and reporting duties within the federal oversight system. They are created and bounded by statute and are located within or attached to the federal entities they oversee rather than constituting a separate constitutional branch.
CourtsCourts adjudicate cases, review legality and constitutionality, enforce rights and provide judicial remedies. They resolve cases and controversies; they are not designed as a continuous public audit and traceability institution.
ProsecutorsInvestigate and prosecute federal crimes under executive authority, subject to courts, criminal procedure and constitutional rights.Criminal enforcement is deliberately narrower than the broader field of lawful but serious public-accountability failures, conflicts, concealment or institutional capture.
FOIAThe Freedom of Information Act creates a judicially enforceable route to many federal agency records.FOIA is a records-access statute with nine exemptions; it is not a general investigatory, evidence-preservation or public-referral institution.
Design rule

Do not duplicate a function merely because it already exists somewhere. A Citizen Branch should justify every function by showing why constitutional independence, citizen governance, cross-government jurisdiction or public traceability materially changes the accountability problem.
